Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, programs, and services offered by Soulistic Vibes Wellness (“Soulistic Vibes,” “we,” “us,” or “our”), operated by Jennifer Gagnon. By creating an account, purchasing a program, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use our services. By using the services, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that are used for fraudulent or abusive activity.

3. Programs & Wellness Disclaimer

Our programs and content provide general wellness, mindset, and lifestyle education. They are not medical, psychological, or professional health advice and are not intended to diagnose, treat, cure, or prevent any condition. Always consult a qualified healthcare provider before making changes to your health, diet, or exercise routine. You use the programs at your own discretion and risk, and results vary from person to person.

4. Purchases, Payments & Subscriptions

• Payments are processed securely by Stripe. By purchasing, you authorize us and Stripe to charge your chosen payment method for the amounts shown at checkout, including applicable taxes.
• If you enroll in a recurring program or subscription, it renews automatically at the stated interval until you cancel. You can cancel future renewals at any time from your account or by contacting us.
• Prices may change; any change applies to future billing periods, not the current one.

5. Refunds & Cancellations

Refund eligibility, if any, is described on the relevant program or checkout page at the time of purchase. Unless a specific refund policy or a non-waivable legal right applies, fees for digital programs and content you have begun accessing are non-refundable. To request a refund or cancel, contact us using the details below.

6. Intellectual Property

All content we provide — including videos, audio, text, workbooks, designs, and trademarks — is owned by Soulistic Vibes or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use the content for your own personal, non-commercial use. You may not copy, redistribute, resell, publicly share, or create derivative works from the content without our prior written permission.

7. Acceptable Use

You agree not to:

• Share your account access or program content with others.
• Reverse engineer, scrape, or attempt to gain unauthorized access to the services.
• Upload unlawful, harmful, or infringing material, or harass other members or staff.
• Use the services in any way that violates applicable law or these Terms.

8. User Content

If you submit messages, questions, or other content through the services, you retain ownership of it but grant us a license to use it as needed to operate and improve the services. You are responsible for the content you submit and confirm you have the right to share it.

9. Third-Party Services

The services rely on third-party providers, including Stripe (payments), Resend (email), Cloudflare (hosting and security), and Neon (database). Your use of those features may also be subject to the providers’ own terms. We are not responsible for third-party services we do not control.

10. Disclaimers

The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the services will be uninterrupted, error-free, or that they will produce any particular outcome.

11. Limitation of Liability

To the fullest extent permitted by law, Soulistic Vibes and Jennifer Gagnon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the services. Where liability cannot be excluded, it is limited to the amount you paid us for the services in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Soulistic Vibes and Jennifer Gagnon from any claims, damages, or expenses arising out of your misuse of the services or violation of these Terms.

13. Termination

You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms or use the services unlawfully. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

14. Governing Law

These Terms are governed by the laws of the Province of Québec, Canada, and the applicable federal laws of Canada, without regard to conflict-of-law principles. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your place of residence, including in the United States.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the services after an update means you accept the revised Terms.
